If you have any written proof that the bank wrote off the overdraft, produce copies. If the conversation took place over the phone, ask the bank to review their telephone tapes of the conversation. If they did assure you that you had no further liability, that should put an end to it very quickly. Most people don’t think to ask about the recorded messages. My husband was saved from being £35,000 out of pocket by referring to a recorded conversation with a bank.

First ask them to send you proof of the debt. It may be best to try and settle for a lower amount than the 634 pounds as the recovery agency probably paid way less to acquire your debt. Make them a low ball offer. Usually they will bite if its reasonable. There is not much you can do really to have the debt removed once they pass it on to a collection agency. The bank doesnt even own the debt anymore so they have totally washed their hands of it.

I had a very similair problem last christmas when i was also the victim of identidy theft. Over 2ooo had gone missing from our account luck have it the bank flagged it ( Good Bank ) and was able to stop this however our overdraft had also been used. We were told we were liable, so we filed a claim form from the banks fraud department. On your statment it should state that the money was used and by which company, ask your bank for a claim form and dispute this strongly. i have now paid £70 for a company which moniters any fraud and covers against any loss of identity theft well worth it for once a year once you have become a victim.

well worth the £70 covers you for everything from any form of identity theft including passports and driving licenses, to ebay and paypal.

But defo fill a claim form and dispute the case failing that get a soliceter involved. Good Luck and sorry this has happened to you.

See the citizens advice bureau who will show you how to negotiate with these people.

You need to contact the orginal creditor and get them to sort out the debt collectors. The debt collectors only act on the information given to them. You don’t owe the money so you shouldn’t pay anything.
